A defendant shall be punished by imprisonment for one year.

The defendant pays 250,000 won to the applicant for compensation by fraud.

Punishment of the crime

On March 20, 2015, the Defendant reported on the Internet opening site at the Defendant’s home located in D 301, Kimhae-si, Kimhae-si, 2015, and made a false statement on the victim’s contact with “to send money first to the Defendant at the time of remittance.”

However, in fact, the Defendant did not have any belief to send money to the victim at the time, and all the money received from the victim was thought to be used for gambling, and thus, there was no intention or ability to send new money even if he received money from the victim.

As such, the Defendant, by deceiving the victim as such, received 340,000 won from the victim to the corporate bank account (F) under the name of the Defendant on the same day as the price for the goods of the same day, and acquired 24,281,000 won in total from the victims on 53 occasions, as shown in attached Table 1 of Crimes List 1.

On July 9, 2015, the Defendant posted a false statement to the effect that he would send 200,000 won to the victim H who reported and contacted the above writing on the same day, by accessing the Internet's main goods transaction site (htp:/www.wbunj.co.kr) at the Defendant's residence located in Kimhae-si, Kim Jong-si, 2015, and then selling 10,000 won of 200,000 won of 20,000 won of her money to the victim H.

However, in fact, the Defendant did not have the above Obaba, and all of the money received from the victim was thought to be used for gambling, so eventually, there was no intention or ability to send Obaba even if the money was paid by the victim.

As above, the Defendant deceiving the victim and received KRW 200,00 from the Defendant’s agricultural bank account through the Defendant’s agricultural bank account on the same day, and by the same method from around that time to July 13, 2015, as shown in attached Table 2.
