Defendant shall be punished by a fine of KRW 2,000,000.

If the defendant does not pay the above fine, 50,000 won.

Punishment of the crime

The Defendant, on the ground of the aftermath of a traffic accident, was hospitalized in the Franchisium D and E, and was diagnosed by a doctor, for 35 days from August 17, 201 to September 10, 201; 48 days from September 14, 201 to October 31, 201; and 20 days from December 21, 201 to January 9, 201; and from January 21, 201 to February 27, 2012, the Defendant hospitalized in the Franchisium for 135 days in total, including 42 days.

However, in fact, the Defendant was not in need of hospital treatment, and the Defendant received sufficient treatment while receiving soup treatment, such as eating and eating herb drugs, and receiving soup treatment, and it is necessary to continue to provide drug medication treatment, so that the patient’s pain may cause inconvenience to the patient’s treatment, and it does not constitute cases where the patient’s condition is unable to cope with pains, or where there is risk of infection. However, the Defendant was hospitalized in the above F&C to claim insurance money to Samsung Life Insurance Co., Ltd. to which the Defendant was enrolled, and received medical treatment.

After that, the Defendant calculated the medical expenses for 135 days, received a certificate of hospitalization and discharge, diagnosis certificate, and receipt of medical expenses, etc., which are documents for hospitalization, and received KRW 3,90,000 from the above company until April 16, 2012, as the Defendant claimed for the payment of insurance proceeds to the victim Samsung Life Insurance Co., Ltd., and received KRW 720,000 on the same day from around that time, and received total of KRW 3,90,000 from the victim company.

As above, the Defendant claimed insurance proceeds from September 20, 201 to April 16, 2012 from around September 20, 2011, to five insurance companies, including Samsung Bio-resources, on a total of 24 occasions, and received total of 27,004,878 won and acquired them respectively.
