1. For the plaintiffs:
A. Defendant G, Samsung Special B, Inc. shall have 4,229 square meters of land for H gas station in Pakistan-si in Gyeonggi-do.
Reasons
1. Facts of recognition;
A. The Plaintiffs are co-owners of the 4,229 square meters of H gas station site in Pakistan-si, Gyeonggi-do (hereinafter “instant Plaintiffs’ land”). Plaintiffs A, B, and C own 5/20 each, and Plaintiff C, 2/20, Plaintiff D, and E own 4/20 each, respectively.
B. Plaintiff C acquired each of the above shares on April 18, 2007, Plaintiff D, and E on July 6, 201, Plaintiff A, and B on November 10, 201.
C. Defendant F and G are co-owners who own 1/2 shares of 1,600 square meters of I factory site adjacent to the instant land (hereinafter “instant Defendants 1”), J factory site (hereinafter “instant Defendants 2”), 708 square meters of J factory site (hereinafter “instant Defendants”) and 2,120 square meters of K factory site (hereinafter “the Defendants 3”).
From January 5, 1999, Defendant F owned each of the buildings 635.5 square meters of a reinforced concrete sloping roof factory built on the land of the Defendants and the buildings built on the land of 2,35.5 square meters of a steel-frame assembly building built on the land of the Defendants, and Defendant G owned each of the buildings 635.5 square meters of a steel-frame assembly building built on the land of 3, and Defendant G owned the building of 1,296 square meters of a reinforced concrete sloping roof factory built on the land of 3, and currently leased the said building to Defendant Samsung Special B&D (hereinafter “Defendant Company”).
E. Defendant F and G installed a retaining wall and a steel fence in line with the boundary line of the instant land and the Defendants’ respective land (as indicated in attached Form 1, 11, 12, 13, 14, 15, 23, 24, 25, 26, 30, 31, 32, 36, 37, 38, 39 in sequence) of the instant land via a boundary survey at the end of the end of 195. The Defendant F and G installed a retaining wall and a steel fence in line with each other. Of the Plaintiffs’ land in the instant case, “A” portion connected to each point of the instant land in sequence of 3 square meters, 24, 25, 36, 27, 34, 36, 34, 36, 36, 36, 34, 36, 36, 36, 427, 27, 329, 34.
