1. The defendant is against the plaintiffs:

A. Of the area of land for a F 1,983 square meters in Nam-si, Namyang-si, each of the annexed drawings 1, 2, 3, 4, 1.

1. Facts of recognition;

가. 원고들은 2008. 1. 28. 피고와 사이에 원고들 소유의 남양주시 F 공장용지 1,983㎡(이하 ‘이 사건 공장용지’라 한다) 중 별지1 도면 표시 1, 2, 3, 4, 1의 각 점을 차례로 연결한 선내 ㈎ 부분 제3호 철골조 샌드위치판넬지붕 단층 공장 198㎡(이하 ‘이 사건 공장’이라 한다)에 관하여 임대차보증금 1,000만 원, 차임 월 100만 원, 임대차기간 2008. 1. 28.부터 2009. 4. 27.까지로 하는 임대차계약(이하 ‘이 사건 임대차계약’이라 한다)을 체결하였다.

Article 5 of the instant lease agreement provides that “The lessee may rebuild or alter the object of the contract with the approval of the lessor, but the lessee shall bear all the costs of the lease in the named city and restore it to its original state.”

나. 피고는 원고들의 승인 없이 이 사건 공장 중 같은 도면 표시 5, 6, 7, 8, 5의 각 점을 차례로 연결한 선내 ㈏ 부분 샤워장 3.3㎡, 같은 도면 표시 9, 10, 11, 12, 9의 각 점을 차례로 연결한 선내 ㈐ 부분 연구실 및 다락방 각 6.6㎡, 같은 도면 표시 13, 14, 15, 16, 17, 18, 13의 각 점을 차례로 연결한 선내 ㈑ 부분 화장실 3.3㎡(이하 위 ㈎, ㈏, ㈐ 부분 각 구조물을 통틀어 ‘이 사건 샤워장 등’이라 한다)를 각 설치하여 사용하고 있고, 이 사건 공장용지 중 별지2 도면 표시 1, 2, 3, 11, 12, 1의 각 점을 차례로 연결한 선내 ㈒ 부분에 농막 24㎡(이하 ‘이 사건 농막’이라 한다)를 설치하여 사용하고 있다.

C. The instant lease agreement is implicitly renewed, and the Defendant is in arrears from December 2013 to December 2013, the Plaintiff’s instant lease agreement is terminated on the ground that the Defendant was delegated by the Plaintiff B, C, and D, and on May 20, 2014, on the ground that “the Defendant was in arrears with at least two rents.”
