1. The Defendant’s payment order against the Plaintiff was based on the payment order of the former prize case before Seoul Central District Court 2019, the 327467.

Basic Facts

The Defendant entered into an insurance contract with C as to the E warehouse building located in Busan Seo-gu (hereinafter referred to as “instant Defendant’s building”), whereby the insured and the insurance period from November 5, 2014 to November 5, 2019 are to guarantee the damage, etc. to be sustained by the insured due to a fire that occurs within the insurance period (hereinafter referred to as “instant insurance contract”).

From September 1, 2014, the Plaintiff is operating a motor vehicle maintenance shop by leasing (hereinafter “instant lease contract”) the building of JJ Ha Dong (JJ 2) around February 1, 2017 among the Plaintiff’s side building (hereinafter “the Plaintiff”) and the part of the Plaintiff’s side building (hereinafter “the instant building”) installed by G from G around February 1, 2014. K is operating the Motor Vehicle Maintenance Division on July 1, 2017 by leasing the taxes, maintenance machinery, etc. operated by G from G.

On the other hand, G had been operated in the part of I Dong and L consent and at the end of the building before the instant lease contract. G installed the compact line (air compresseder) on the rear side of the J-dong building, and installed four compact lines from the compressed air, and linked each of the above compact line to the end of the building and I Dong, J Dong, warehouse building, etc. so that it can carry on the maintenance facilities and the Deputy Director-General's business by using the compressed air of the said compact line.

On November 6, 2018, at least 01:00, a fire (hereinafter referred to as “the fire in this case”) occurred in the part after the warehouse of the maintenance shop leased by the Plaintiff, following, and caused damage to the Defendant’s building and M’s factory building and M’s factory building in the Dong, J, and neighboring areas.

According to the report of the results of joint identification at the fire site of the Busan Northern Fire Department, the point of combustion is "Presumption to be near the Ecomp Bair," but the cause of fire was "the cause of the fire to find electric characteristics on the line of Ecomp Bas presumed to be the first point of combustion, and the causes of the fire were to find electric characteristics on the line of Ecomp Bas.
