Reasons
Punishment of the crime
At around 07:00 on November 5, 2016, the Defendant, while under the influence of alcohol of 0.187% in front of the river basin located in Seoul Special Metropolitan City, Nowon-gu, the lower court proceeded at a speed that makes it impossible to identify one lane in the direction of the river basin in the direction of relay.
In the same direction as at the time, the victim D(61) was followed by the disabled call taxi driven by the victim D(61), and therefore, the driver had a duty of care to ensure and proceed with the safety distance that can be avoided when the vehicle stops.
Nevertheless, the Defendant neglected to stop a disabled call taxi driven by the above victim D in accordance with the red signal such as an electric signal, and failed to properly operate the brake and steering wheel system, caused the above victim D's failure to drive the above disabled call taxi in the traffic signal atmosphere from the first lane to the front part of the car driven by the victim D, who driven by the above victim D, while driving the above disabled call taxi at the right part of the traffic signal.
