피고인은 처 E 등과 공모하여 2014. 7. 25. 09:40경 양주시 F아파트 801동의 3~4라인 1층 출입구 출입문과 각 세대 우편함, 1층 알림 게시판, 엘리베이터 내 게시판 및 703호와 704호 각 현관문에 ‘시민사회에 고발합니다!!!’라는 제목으로 “F아파트 801동 704호에 거주하는 D를 사회에 발을 붙이고 살아서는 안 되는 파렴치한 철면피 인간임을 시민사회에 고발합니다 (중략 1)17세 때 서울에서 학교를 보내준다고 데려와서 학교는 안보내고 35세까지 염전노예처럼 창살 없는 감옥에서 일만 시켰습니다 (중략) 5) 결혼할 시기가 되었지만 결혼 또한 마음대로 못하게 한 사람입니다. 6)그동안 일을 했던 댓가를 수십 차례 요청 했으나, 형님이 돌아 가시자, 월급을 주었다며 세무조사 대비용 임금대장 한 장을 만들어 모든 것을 덮었습니다 (중략) 801동 704호 D는 부모님과 형님이 안 계신다고 어릴 때부터 데려다 갖은 핍박을 하며 일을 부려먹고 저의 정당한 요구를 묵살하는 반인륜적인 사람이라는 것을 시민사회에 알려 정의로운 사람이 사는 사회라는 것을 고발하는 바입니다” 라는 내용이 기재된 인쇄물 10여장을 게시하거나 배포하였다.
