A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

Punishment of the crime

The Defendant is a person who served as the director of the management office of Jung-gu Seoul Metropolitan Government from August 14, 2008 to November 30, 2018 and has been in charge of the management of the above apartment, including the facility management, accounting and accounting of the above apartment, and the accounting of the victim B apartment autonomous council.

1. Around March 2014, the Defendant, at the above apartment management office, was issued a monthly rent of KRW 2,900,000 from C representative D who leased a part of the building from the victim’s residents’ autonomous council, and was in custody for the victim at around that time, used the Defendant’s living expenses, children’s hospital expenses, etc. at the location where the Defendant’s residence was located.

From this point to January 31, 2018, the Defendant deposited monthly rent of 25 times at the same place as indicated in the attached list of crimes (1), and consumed the monthly rent of 72,50,000 won in total at the same place as the Defendant’s living expenses or children hospital expenses.

2. On July 6, 2017, the Defendant embezzled funds for special repair and maintenance, at the management office of the above apartment, withdrawn 500,000 won from the location of the E Bank New Station located in Jung-gu Seoul Metropolitan Government under the name of the special repair and maintenance reserve fund, from the location of the Defendant’s residence, etc. on the same day, and consumed it by the Defendant’s living expenses, children’s hospital expenses, etc.

From this point to May 9, 2018, the Defendant consumed 5,000,000 won in total, from the special repair appropriation fund to 10 times in the same place as indicated in the attached list of crimes (2) in the same manner as the Defendant’s living expenses or children hospital expenses.

3. On July 30, 2017, the Defendant embezzled for retirement benefits, at a branch office of E Bank Party located in Jung-gu in Seoul Special Metropolitan City as a passbook for company management expenses, withdraws KRW 479,470 from the position of E Bank Party located in Jung-gu in Seoul Special Metropolitan City for retirement benefits in the name of the Defendant’s residence without permission.
