Reasons
Punishment of the crime
The defendant was a person who was a de facto marital relationship living together with the complainant B from May 2006 to March 20, 2013.
1. Forgery of private documents;
A. On March 4, 2013, the Defendant: (a) stated “B” in the column for the date and time of delegation “C” in the resident registration number column of “C” in the name of “C” on the paper for delegation of a certificate of seal imprint kept at the office of Song-dong, Pyeongtaek-si; and (b) affixed B’s seal imprint on the name following the name.
Accordingly, for the purpose of exercising, the Defendant forged two copies of a certificate of seal imprint under the name of private document B, which is a private document on rights and obligations.
B. On March 14, 2013, the Defendant entered “C” in the seller’s resident registration number column “B” in the column for “B” in the real estate sales contract indication column in the real estate sales contract indication column, and affixed B seal by the complainant to the name of “B” on the seller’s resident registration number column.
Accordingly, for the purpose of exercising, the Defendant forged a real estate sales contract in the name of B, which is a private document on rights and obligations.
2. Uttering a falsified investigation document;
A. The Defendant issued a forged certificate of seal imprint to the public official in charge of the office of Songbuk-dong, who is aware of the forgery at a time and time as mentioned in the above 1. Paragraph (1) and exercised it by obtaining six copies of the certificate of seal imprint in B’s name.
B. On March 14, 2013, the Defendant issued a certificate of completion of real estate transactions in B’s name to a public official in charge of being aware of the forgery at the office of Song-si, Seo-dong, Pyeongtaek-si, which is located in Pyeongtaek-si, as seen above, as if the contract was duly formed, and exercised it.
