피고인은 2017. 12. 25. 20:10 성남시 분당구 판 교역로 160, 판교 역 동편 버스 정류장 앞 위 버스 안에서, 좌석에 앉아 술에 취해 옆으로 쓰러지는 자신을 깨웠다는 이유로 버스 승객들이 있는 가운데 피해자에게 “ 내려와 씹할” 이라고 욕설을 하며 자신의 휴대폰을 들고 때리려는 시늉을 하고 휴대폰을 위 버스 바닥에 내리치는 등 소란을 피워 위력으로 피해 자의 버스 운행업무를 방해하였다.
