The defendant shall receive KRW 2,178,00 from the plaintiff, and at the same time, motor vehicles listed in the separate sheet are stated in the plaintiff.

Facts of recognition

From October 1, 2002, the Plaintiff concluded an entrustment contract with the Defendant and completed business registration, and operated the vehicle under the name of the Defendant, and the existing vehicle was replaced by the vehicle listed in the separate sheet (hereinafter “instant vehicle”).

On December 5, 2016, the Plaintiff notified the Defendant of the termination of the entrustment contract and requested the transfer registration of ownership of the instant vehicle.

The Plaintiff operated the instant vehicle even after the closing date of the argument, and the unpaid admission fee of the instant vehicle is KRW 2,178,000.

[Reasons] The former Trucking Transport Business Act, amended by Act No. 7100 of Jan. 2004, which was amended by Act No. 7100 of Jan. 20, 2004, converted the registration system of trucking transport business into the permission system to resolve imbalances caused by excessive supply of trucking transport business. However, Article 3(2) of the Addenda of this Act provides that "any person who intends to operate the trucking transport business from December 31, 2004 to December 31, 2004, after cancelling the title trust and the entrustment contract and cancelling the entrustment contract, among those who are entrusted with the trucking transport business to the operator of the trucking transport business at the time of the promulgation of this Act, may apply for permission to the Minister of Construction and Transportation, notwithstanding the provisions of Article 3(5)1 (the criteria for permission or alteration of permission accompanying trucking transport business shall meet the supply criteria publicly notified by the Minister of Construction and Transportation by type of business under paragraph (4) in consideration of the demand for cargo transport."

According to Article 9 Subparag. 3, Article 12(6), and Article 16 of the Automobile Management Act, Articles 21 and 24 of the Decree on the Registration of Automobile, and Article 27(1)6 of the Rules on the Registration of Automobile.
