A defendant shall be punished by imprisonment with prison labor for four months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

Punishment of the crime

On June 9, 2017, the Defendant was sentenced to two years of suspension of the execution of imprisonment with prison labor for violating the Customs Act at the Incheon District Court on June 17, 2017.

No one shall sell foods, etc. for which an import declaration has not been filed, or collect, manufacture, import, process, use, cook, store, subdivide, transport or display such foods for sale.

The Defendant’s mother B collected used domestic agricultural products for the purpose of selling them in the Republic of Korea, which were not reported through the merchants, a Chinese passenger ship, the Chinese passenger ship between the Chinese tindo and the Incheon Port, and collected them from D and E, and had the Defendant shared to transport them to the storage by requesting the Defendant to drive the above knife.

Accordingly, B, around May 31, 2017, purchased agricultural products 1,310km (purchase price of KRW 3,784,00), such as 150 km in China, which was prepared to make an import declaration from merchants at the first international passenger ship terminal collection center in Jung-gu Incheon, Jung-gu, Incheon. At the request of B, B loaded agricultural products transported from the storage warehouse in the Dong-gu, Incheon, to the warehouse into the warehouse, and loaded agricultural products transported from the warehouse in the same manner as B to the warehouse, and then loaded agricultural products transported to the warehouse in total on two occasions as shown in the list of crimes in attached Form 4,721km (purchase price of KRW 14,737,40) or loaded agricultural products into the warehouse.

Accordingly, the Defendant sold food, etc. for which the import declaration was not filed more than twice, or aided and aided the act of importing food, etc. for sale purposes.
