Defendant shall be punished by a fine of KRW 700,000.

Where the defendant fails to pay the above fine, one hundred thousand won shall be one day.

Punishment of the crime

On February 17, 2016, when the victim came to know of the fact that the victim was a preliminary candidate for the special election of F Council members on the grounds that the above C was running the same kind of business after transferring the D main points of the defendant's son to his/her wife E, and thereafter, C was forced to file a civil lawsuit against the victim for the reason that the above C was running the same kind of business, the defendant was not able to give appraisal among each other.

피고인은 2016. 3. 7. 17:13경 불상의 장소에서 피고인의 페이스북 게시판에 “E 후보에게 소송을 당해서 곤란한 지경에 있는 사람으로서 한마디 해야겠네요. (중략) 또 딸에서 E로 사업주를 변경 했더군요. 정치한다고 나선 사람이 D 사업주로 나선거니다. 실제 E가 D를 운영한다구요.. ㅎㅎ 웃을 일입니다. 아들 나이같은 그것도 학교 후배의 조그만 가게 민초의 밥상을 뒤엎어려고 갖은 노력을 하는 E입니다. (중략) 이런 후보가 정치판에 뛰어든다구요 아무리 정치가 무슨 판이라도 E는 아닙니다. 절대 공공의 이익과 G 시민의 이익을 위해 봉사를 할 사람이라고 보입니까 조금만 거슬리면 법을 찾고 경찰서 문을 두드리는 인물이 G시민을 대표 한다구요 웃습니다 ㅎ“라는 내용의 글을 게시하여 피해자가 당선되지 못하게 할 목적으로 공연히 사실을 적시하여 피해자를 비방한 것을 비롯하여 2016. 2. 19.경부터 2016. 3. 7.경까지 사이에 별지 범죄일람표 기재와 같이 4회에 걸쳐 피고인의 페이스북, 피해자의 페이스북 게시판에 글을 게시하여 피해자가 당선되지 못하게 할 목적으로 공연히 사실을 적시하여 피해자를 비방하였다.
