Reasons
Punishment of the crime
1. Defendants A and B were married couple and operated the livestock industry with the trade name “I” from February 2, 2012. A
1) Violation of the Livestock Products Sanitary Control Act (1) in order to operate meat packaging business without permission by the competent authority for each workplace. The Defendants, without obtaining permission for meat packaging business from the competent authority, installed one heat box, one machine extracted by hair, four work units, two washing facilities, etc. in the “I” workplace operated by the Defendants, and cut off and packaged 40 kinds of ducks around November 5, 2013, as shown in attached Table 1, from around November 5, 2013 to August 17, 2015, the Defendants conducted meat packaging business without permission from the competent authority. The Defendants conspired to report meat packaging business without permission from the competent authority and conducted meat packaging business without permission. On November 6, 2013, the Defendants sold original 7 70,000 won to the “J” restaurant, as shown in attached Table 2, from November 6, 2013 to August 13, 2015, 723 times, including 2,37 mari, 2,231 mari in total, 17,77,010 won from November 6, 2013 to August 13, 2015.
Accordingly, the Defendants conspired to sell livestock products without reporting to the observational authorities.
3) No person who sells or stores livestock products with the expiration date indicated on the relevant livestock products shall sell or store them for the purpose of sale. The Defendants, together with the Defendants, engage in the livestock product sales business without reporting to the competent authority, as stated in the foregoing paragraph 2, and around January 22, 2014, he/she was slaughtered from K around January 17, 2014, and “from the date of manufacture: 10 days from the date of manufacture, and date of manufacture: January 17, 2014.”
