A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The Defendant, who operates the repair company in Suwon-si, Suwon-si, was able to receive the repair cost by accepting not only the damaged part of the motor vehicle caused by the accident but also the damaged part of the motor vehicle that occurred due to the accident as well as the damaged part of the motor vehicle that occurred due to the accident and receiving the false insurance from the damaged insurance company as if the single accident occurred.
On October 14, 2016, the Defendant conspiredd with D Motor Vehicle Borrower E who visited the said “C” repair business, and in fact accepted D Motor Vehicle parts by spreading, etc. despite the fact that there was an accident that only the rear part of the motor vehicle was contacted, the Defendant received insurance from the victim F Co., Ltd. as if he accepted the said whole due to a single accident, and acquired it by receiving the amount of KRW 220,40,000 (actual damage amount) from the victim as repair cost.
In addition, the Defendant, from February 16, 2015 to June 21, 2017, by deceiving the victims on a total of 69 occasions, as shown in the attached list of crimes, and acquired the total amount of 67,046,250 won (amount of actual damage 40,04,605 won) as repair expenses.
