피고인은 2016. 2. 20. 경 불상의 장소에서, 사실은 피해자 E의 내연 녀로 알려 진 피해자 F의 최종 학력이 중학교 졸업이 아님에도 불구하고, 네이버 포털 사이트 아이디 G으로 접속한 후 ‘H’ 라는 기사의 댓 글 란에 ‘ 중졸에~~~~~ 허 위 학력 자랑질에~~~ E은 첩년을 I 여 친이라고 ㅎㅎㅎㅎㅎ 지금은 거짓말한 걸 알까요 ’ 라는 내용의 댓 글을 게시하는 등 그때부터 2016. 6. 3. 08:44 경까지 별지 범죄 일람표 기재( 순 번 4 제외) 와 같이 총 5회에 걸쳐 비방할 목적으로 정보통신망을 통하여 피해자 E, 피해자 F에 대한 거짓의 사실을 드러 내 어 피해자들의 명예를 각각 훼손하였다.

A. There is no proof that the writing written by the defendant is false.

B. Since the Defendant reported several media reports and believed that the content of the comments was written in comments based on such media reports, there was no perception that the content of the comments is false.
