Reasons
Punishment of the crime
1. Around 00:40 on July 18, 2017, the Defendant and B, who violated the Special Act on the Prevention of Insurance Fraud, knew that C would drive a Dworket E-car on the road in front of the Jinjin-gu, Jinjin-gu, Jinjin-gu, Seoul, 47-ro 2,00,000, while drinking alcohol, were aware that C would intentionally cause a traffic accident by using a vehicle with low-string in B (the Defendant is the Chief Roon) and intended to receive insurance money.
In order for C to park a rocketing car at the above location, the Defendant and B moved the rocketing car into the front part of the low-speed car in front of the right side of the low-string vehicle, caused C to receive a traffic accident by taking the top part of the front part of the low-string vehicle, and caused C to receive the insurance accident as if the said traffic accident occurred due to negligence of C.
The Defendant and B received from the injured party the delivery of KRW 3 million on July 24, 2017, KRW 204,00 on July 28, 2017, KRW 497,80 on July 31, 2017, KRW 72,990 on the name of treatment expenses, KRW 487,970 on August 22, 2017, KRW 4,262,760 on the pretext of medical treatment expenses.
Accordingly, the defendant acquired insurance money by insurance fraud in collusion with B.
2. Special property damage Defendant and B received the front part of the left-hand part of the rocketing car as set forth in the above paragraph 1 with the aim of intentionally inducing traffic accidents against the victim C (S 44) and acquiring insurance proceeds by deception, as above, at the time and place set forth in the above paragraph 1.
Accordingly, the Defendant, in collusion with B, destroyed the car with a dangerous object, thereby damaging the car amounting to KRW 457,00 in repair cost.
