Reasons
Punishment of the crime
1. The Defendant was sentenced to one year of imprisonment with prison labor on September 28, 2016 and the judgment on December 30, 2016 became final and conclusive on December 14, 2017. On December 14, 2017, the Seoul Southern District Court sentenced the Defendant to 8 months of imprisonment with prison labor and 100,000 won of fine by interfering with business affairs, etc., and completed the execution of sentence in the lawsuit of the first intersection of the North Korean Northern Branch on June 29, 2018.
2. Facts of crime;
A. A. (1) On July 16, 2018, the Defendant insultd the victim C by openly insulting the victim by having the victim’s “as a member of the victim’s husband in Guro-gu Seoul Metropolitan Government D’s “I am smoking,” “I am smoking,” while smoking tobacco from the victim’s husband in the “E cafeteria restaurant operated by the victim C (Woo 65 years of age)” around 18:30 on July 16, 2018.
