All prosecutions against the Defendants are dismissed.

1. The Defendants in the facts charged against the Defendants are the taxi engineers belonging to a limited liability company D, who have been on the part of the president E of the said company, and the victim F (ma, 64 years old) is the chairperson of the Trade Council, which is the friendship group of the employees of the said company.

On December 2, 2017, the Defendants prepared a criminal complaint, such as embezzlement of company funds, by receiving joint signature from a pro-friendly employee in order to file a criminal charge with the president E around the end of the end of the month. In the process of finding the weak points of the victim, the victim was suspected of arbitrarily using the funds of the normal conference, and the Defendants were willing to discuss these circumstances to the employees of the company and pressure the victim.

피고인들은 2018. 1. 10. 17:00 순천시 G에 있는 유한회사 D 내 교육실에서 전체 직원들에 대한 안전교육이 끝난 후 위 회사의 직원 30여명이 듣고 있음에도 피해자에게 H은 ‘상조회장 F이 상조회비를 횡령했고, 도둑놈 사기꾼이다. 상조회장직을 박탈시켜야 한다. 사장에 대한 고소비용 40만 원과 총무가 준 돈을 가지고 와라, 이 사기꾼 새끼야. 상조회비를 횡령했으니 F 니가 도둑놈이고 사기꾼 아니냐. 상조회장 사기꾼 새끼야 돈 가지고 와라. F이 상조회비를 횡령했으면 사기꾼인데, 좋게 해 줄 테니 사장 고소를 취하해라. 그러면 우리가 좋게 해 주겠다’라는 등의 말을 하고, 피고인 B는 ‘사장이 돈을 너한테 줬다는데 돈 가져와 사기꾼 새끼야. 이 니가 사기꾼 아니면 사장이 사기꾼 아니냐. 둘 중에 하나는 사기꾼인데 우리는 사장을 따른다’라는 취지로 말하였으며, 피고인 A는 ’사장에게 지급할 발전기금 48만 원을 내놔라. 너는 사기꾼 새끼니까, 그 돈을 내놓지 않으면 죽여버린다‘라는 등의 말을 하고, 피고인 C은 '사장이 발전기금으로 1,210만 원을 줬다는데 그 돈을 어디다 뒀냐, 가지고 와라.
