1. Joint crimes committed by the Defendants

가. 업무방해 피고인들은 2011. 12. 20. 23:20경부터 같은 날 23:50경까지 창원시 마산회원구 E에 있는 피해자 F가 경영하는 'G주점'에서 서로 욕설을 하며 시비를 벌이던 중 피고인 A은 그곳에 있던 맥주병을 탁자에 내리쳐 부수고, 이에 피해자가 이를 만류하자, 피고인 C은 피해자에게 "씹할 년아, 술장사 하다보면 병도 깰 수 있지" 라고 욕설을 하고, 그곳 손님에게도 "늙은 게 나이 쳐 먹어 가지고, 야 이 씹할 놈아" 라고 큰소리로 욕설을 하고, 피고인 B, 피고인 A도 그곳 손님들에게 욕설을 하고, 피고인 A은 그곳에 있던 맥주병을 그곳에 설치되어 있는 냉장고에 집어 던져 소란을 피워 그곳 손님들로 하여금 위 주점에서 나가도록 하였다.

나. 공무집행방해 피고인들은 2011. 12. 21. 00:10경 위 가항 기재 장소에서 위 F의 신고를 받고 출동한 마산동부경찰서 H파출소 소속 경위 I 외 1명이 위 F로부터 신고경위를 청취한 후 계속 행패를 부리는 피고인들에게 그만두지 않으면 체포를 하여 파출소에 동행을 하겠다고 고지하자, 피고인 A은 주먹으로 위 I의 복부 부위를 때리고 발로 다리를 수회 차고, 이에 가세하여 피고인 C은 손으로 위 I의 멱살을 잡고 주먹으로 목 부위를 때리고, 이에 가세하여 피고인 B는 발로 위 I의 다리 부위를 찼다.
