Defendant shall be punished by a fine of five million won.

If the defendant does not pay the above fine, KRW 100,000.

Punishment of the crime

피고인은 2014년 7 월경 인터넷을 검색하던 중, B이 미국에서 대학교과정 교육을 받아 영어에 능통한 사람으로 토익 (TOEIC, Test of English for International Communication), 텝스 (TEPS, Test of English Proficiency developed by Seoul National University) 등 공인 영어시험에 대리 응시하여 높은 점수를 획득하여 줄 수 있다는 광고성 글에 자신의 이메일 주소를 게시하여 홍보하고 있음을 발견하였다.

1. The Defendant, on the e-mail, contacted B with the above promotional writing, sent a photographic document along with the request for an e-mail application, sent it to B, and received a synthetic photograph according to B’s instructions after synthesis with B’s certification photograph, and thought it to create an identification card with a synthetic photograph attached.

Accordingly, on April 12, 2017, the Defendant prepared an application for the re-issuance of a driver's license in the C driver's license test site (SYD), and attached a synthetic photograph delivered by B in the photo column of the said re-issuance application to the staff in charge, and stored it in the C driver's license information system register by submitting it to the staff in charge. As such, the Defendant eventually caused the staff in charge to enter the false fact into the driver's license of the Defendant under the name of the C driver's license in the Busan Regional Police Agency by attaching a synthetic photograph granted by B to the staff in charge.

The defendant, in collusion with B, made a false report to the public official, and made him enter false facts in his license.

2. Proxy: The Defendant, who intrudes on a structure, exercise of a false certificate of license, was designated by B as the test site and date and time to take the examination by proxy, filed an application for soil benefit examination at the above test site and time, and registered a synthetic photograph under Paragraph 1 above in the examination column.

Accordingly, B around April 15, 2017, after the application of the defendant to the E-school test site (Seoul Gangnam-gu F).
