A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. On October 6, 2013, from around 04:00 to 06:40 on the same day, the Defendant: (a) was divingd in the 6th floor area in Bupyeong-si, Seocheon-gu, Seoul; (b) discovered and brought up one smartphone in the victim E, the market price of which is equivalent to 50,000 won; and (c) discovered and brought up one smartphone.
2. The Defendant discovered one unit of S2 Smartphone in a gallon owned by a victim of a 400,000 won or more at the time and place specified in paragraph (1).
3. The Defendant discovered one gallon smartphone in a gallon owned by the injured party G, the market value of which is equivalent to KRW 500,000,000,000 in the victim G that was divingd at the time and place stated in paragraph 1, and brought it back as it is.
4. On October 13, 2013, from around 00:00 to 09:00 on the same day, the Defendant: (a) held the clothes of a sloping room used by the victim H and brought about one smartphone and 600,000 won in cash in the gallon of the market price in which the victim H was in use; and (b) taken soup.
5. On October 14, 2013, from around 09:00 to around 11:00 of the same day, the Defendant discovered one gallon smartphone in a gallon owned by the victim K, and brought about the same gallon in a gallon owned by the victim K, located adjacent to Incheon Gyeyang-gu, Jina or male room located adjacent to Incheon Gyeyang-gu I.
6. On October 15, 2013, at around 11:30 on October 15, 2013, the Defendant: (a) discovered one unit of S4 smartphone in a gallon owned by the victim’s name in front of the victim’s name in a gallon or male room located adjacent to the victim’s name in a gallon or male room; (b) brought it back as it was.
7. On October 17, 2013, from around 10:00 to around 11:30 of the same day, the Defendant: (a) discovered and brought about a 800,000 won smartphone owned by the victim N, located adjacent to the victim N, who was divingd in the Jari or male room located in Gyeyang-gu Incheon Metropolitan City I.
