Reasons
Punishment of the crime
[Criminal Justice] On August 13, 2009, Defendant B was sentenced to a suspended sentence of three years on August 13, 2009 to imprisonment for fraud, etc. at the Seoul Southern District Court on August 21, 2009, and the above judgment became final and conclusive on August 21, 2009. On November 29, 2010, Defendant B was sentenced to a suspended sentence of two years on December 7, 2010 by imprisonment with prison labor at the Seoul East East District Court for fraud.
【Criminal Facts】
1. Defendant A [G, H, and I co-principal behavior-(State)J], while running an individual business with the trade name of K, H was placed in custody of the representative of the State (State)J, which was converted into G upon G’s recommendation, and I was called as a joint guarantor, and Defendant A was entrusted with the role of falsely manipulating the export performance of the (State)J according to the direction of G, through a financial institution delegated by the Korea Trade Insurance Corporation (the Korea Export Insurance Corporation prior to the change), through which the Korea Trade Insurance Corporation (the Korea Export Insurance Corporation prior to the change) received export credit guarantee in the name of the Korea Trade Insurance Corporation and provided it as security to the financial institution and conspired to acquire trade financing loans from the financial institution.
Accordingly, on May 12, 2006, H, G, etc. applied for export credit guarantee prior to shipment and trade financing loans under the name of the (ju) J at a two-way branch of the Bank of Enterprise Bank (a financial institution entrusted with the affairs related to export credit guarantee by the Korea Trade Insurance Corporation) located in Yangcheon-gu Seoul Metropolitan Government on May 12, 2006 (the date of application for a loan under the commercial status table: (1) year major export counter-party to the transaction as of the date of application for a loan under the commercial status table: (70,000,000,0000,0000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,00,000,00,000.
