A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

On October 2008, the Defendant received a proposal from the name influenite (hereinafter “C”) who is the brode of trade financing fraud loans (hereinafter “C”) and accepted the proposal that “I would make a payment on the face of a joint guarantor in the documents borrowed from a trade financing bank.”

D In order to obtain trade financing fraud loans, after establishing a disguised company E, requested F to provide a fraudulent loan to F, which is the hub of trade financing fraud loans, and then entering the defendant as an executive officer of the above E's share as a joint guarantor, G makes a false domestic export performance according to F's instructions, and H introduces I to F, and I shared the role of requesting a trade financing to the person in charge of the central branch of the U.S. branch of the Bank of Korea (the Korea Trade Insurance Corporation entrusted with the business of export credit guarantee by the Korea Trade Insurance Corporation) of the Bank, after having obtained an export credit guarantee under the name of the Korea Trade Insurance Corporation through the above financial institution, and offered it as security to the financial institution, and conspired to acquire it by receiving a trade financing loan from the financial institution on the basis of false export performance.

Accordingly, on October 15, 2008, the Defendant applied for export credit guarantee and trade finance loans under the name of "domestic export performance: as of December 2007, J 12,50 million won; (14,200 million won; (200,000 won; (40,000 won; (30,000 won; and (4),70,000 won; (4),00,000 won; and (3),00,000 won; (4),00,000 won; (160,000 won; (1); (40,000 won; (4),00,000 won; (40,000 won; (3); (40,000 won; (4),00,000 won; and (3),00,000 won; and (2),00,000 won,00 won; and (3),00,000 won,00 won.

The Korea Trade Insurance Corporation shall submit false export performance data to the extent of 100 million won.
