Defendants are not guilty.
Reasons
1. The summary of the facts charged is as follows: (a) Defendant A went out of the partnership head of K apartment (hereinafter “instant apartment”) on May 21, 201; (b) but, on July 27, 2013, Defendant A was elected from the partnership head of the instant association and worked as the head of the said association as a public official under the Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents; (c) Defendant B was the representative director of L Co., Ltd. (hereinafter “L”) from April 206 to September 30, 201, taking charge of the management and supervision of the execution of the said company’s funds, business affairs, and orders for removal works; and (d) Defendant C was the person in charge of the removal of the said company’s capital from August 200 to September 30, 201 to September 30, 201.
On October 14, 2003, the association of this case was authorized to establish an association, and was promoted a reconstruction improvement project for new construction of 303,199 square meters, total floor area of 1,16,81 square meters, total floor area of 6,62 households (general sale 1,27 households, lease 395 households, floor area ratio 249.99%) with total floor area ratio of 5,040 households of this case completed June 1982 as Hyundai Construction Co., Ltd. and Hyundai Industrial Development Co., Ltd.
On February 8, 2007, the association of this case lost the qualification as the president of the whole association, and from September 10, 2007, the association of this case was promoting to elect the president of the association by temporarily entrusting an attorney-at-law with the duties of president of the association.
Defendant
A appears to be a clerical error in the indictment on April 201, 201, as a member of the instant association, and the phrase " April 201," written in the indictment on April 201.
From around April 2003 to April 2003, the 10th council of occupants' representatives of the instant apartment, from April 2003 to April 2005, the said council of occupants' representatives serves as the director of the said apartment, from April 2005 to April 2007, and from April 2007, the said council of occupants' representatives serves as the representative of the said association.
