The prosecutor's appeal is dismissed.
Reasons
1. The summary of the grounds for appeal is that the judgment of the court below is erroneous in misconception of facts by not guilty of the defendant, even though the passenger car driven by the defendant (hereinafter referred to as the "car in this case") deviates from one lane and an accident occurred due to the shock of the bus boarding by the victims who were going on the two lanes (hereinafter referred to as the "the bus in this case").
2. Based on the following facts and circumstances, the lower court found the Defendant not guilty on the grounds that the first shock level, the place of collision, and the place of collision at the time of the accident cannot be specified, and that the Defendant and the bus article left a lane; and that the instant car depart from the lane and caused a traffic accident by shocking the instant bus, is insufficient to readily conclude that the instant bus caused a traffic accident.
There is no clear evidence to confirm that there is no video recording on the bus article E and the Defendant's statement about the first location of collision, the first place of collision, the number of collisions, and the number of collisions between automobiles and buses.
B. At the investigation agency and the lower court’s trial, E, a bus engineer, stated that the bus’s “indiciated” of “indiciated” was cut to the right side and that the bus was cut to the right side of the road to the extent that it was impossible to manipulate the hand, and that the bus was cut to the right side of the road, and that bus passengers L, H, J, I, and G were shocked once in the bus at the court below’s court, and that the collision was not known to the effect that all the articles and passengers of the bus at the time were the front or rear of the collision.
C. According to the traffic accident comprehensive analysis written by the MM affiliated with the Road Traffic Authority, the back left part of the bus is highly likely to first conflict with the front right part of the passenger vehicle, considering the string of the two-lanes of the accident site, the damaged part of the vehicle, and the moving direction after the collision.
