Reasons
1. Facts of recognition;
A. On August 15, 1914, the GJ received a ruling from 241 square meters in the Republic of Korea (hereinafter “I land before annexation”) in the Republic of Korea, the GJ received the transfer of ownership on August 15, 1914, and on August 15, 1914, the GJ received the transfer of ownership on August 15, 1914.
Part B L has completed registration of initial ownership of the land I and K before the merger on February 14, 1917.
B. B completed the registration of ownership transfer due to sale on May 14, 1978 by the former Act on Special Measures for the Registration, etc. of Ownership of Real Estate (amended by Act No. 3094 of Dec. 31, 197, hereinafter “Special Measures Act”) with respect to I land prior to the merger on October 7, 1980, and completed the registration of ownership transfer due to the donation on May 7, 1967 under the former Act on Special Measures for the Registration, etc. of Ownership of Real Estate (amended by Act No. 4502 of Nov. 30, 1992; hereinafter “Special Measures Act”) with respect to K land prior to the merger on January 28, 1995.
In fact, the land of I and K prior to the merger was inherited to B in succession through J, L (Death on May 10, 1959), M (B’s refer, death on April 30, 1964), and B died on May 19, 2015 while the lawsuit of this case was pending, and the Defendants, their wife and children, inherited it.
C. Following the annexation, each land of I and K was combined on April 3, 2012, and became 496 square meters (hereinafter “instant land”). D.
With respect to the 314m2 adjacent to the land of this case, JJ's Fourth, P completed the registration of transfer of ownership on June 19, 1931. The Plaintiff's husband P completed the registration of transfer of ownership on June 29, 1993 pursuant to Special Measures (No. 4502) for sale on August 1, 197.
The Plaintiff completed the registration of ownership transfer on July 9, 2007 with respect to the above land on the ground of donation, and the above land is merged with Q Q 125 square meters owned by the Plaintiff.
