1. The Defendant paid KRW 77,438,566 to the Plaintiff KRW 5% per annum from June 23, 2017 to September 15, 2017.
Reasons
1. Basic facts
A. On July 25, 2003, the Plaintiff acquired ownership of each real estate listed in the separate sheet (hereinafter “instant shopping mall 1, 2, and 3”) among the buildings of Seocho-gu Seoul, Seocho-gu and D ground and the 2nd underground floor B shopping mall (hereinafter “instant shopping mall”). The Defendant is a non-corporate body that is responsible for the management of the instant commercial building.
B. Since July 25, 2003, the Plaintiff acquired ownership of the 1, 2, and 3 shopping mall of this case, the Defendant occupied and used the following parts among the 1, 2, and 3 shopping mall of this case.
1) The explanation of the survey on the status of the attached Form 1 floor also shows that “the old level of facilities occupied by others within the part of the Plaintiff,” 9, 1, 2, 1, 2, 2, 999, and 21.15 square meters in the pumps room (hereinafter “the part of the attached Table 1”) connected each point in sequence.
