A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

1. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Intimidation, etc.) committed by the Defendant, on November 7, 2013, stolen property of the victim C (the age of 61) and committed indecent act by force on or around October 2013 and around February 17, 2014, the Defendant was detained due to larceny and indecent act by force at the residents of the Daegu District Court on April 21, 2014, and was tried to be tried on the said case in the court under subparagraph 1 of the resident support of the Daegu District Court on June 10:40 on June 17, 2014, and was tried to take a trial on the said case against the victim who made a statement at an investigative agency and to take a retaliation against the victim.

피고인은 2014. 6. 17. 13:00경 위 재판이 끝난 후 문경시 D에 있는 피해자가 운영하는 ‘E’ 음식점 앞으로 가, 그곳에서 일을 하던 피해자를 보고 주먹을 쥔 손을 들어 피해자를 향해 때리는 시늉을 하며, “나한테 죽는 줄 알아”라고 말하고, 피고인이 타고 온 자전거로 식당 주변을 배회하며 식당 앞을 지날 때마다 자전거에 부착된 종을 울리고, 피고인의 휴대전화로 피해자에게 수회 전화하여 “날 잡아 넣어, 빨리 잡아넣어”, “내가 경작하던 밭에 나 아니고 딴 놈이 농사를 지으면 외숙모(피해자)하고 둘 다 죽을 줄 알아”라고 말하는 등 피해자를 협박하였다.

Accordingly, the defendant threatened the victim with the purpose of retaliation against the victim who made a statement of damage in connection with his criminal investigation or trial.

2. A thief: (a) around November 21, 2013, the Defendant stolen the victim’s market price at approximately KRW 10,000,00 in a cooling house installed in front of the entrance, and kept in front of the entrance, at around 21:20,000.

3. Indecent acts by compulsion;

A. The Defendant came to the above restaurant around 20:00 on October 2013, and entered the restaurant with the mind of having the victim confirmed that the victim is mixed, and committing an indecent act against the victim.
