The reasoning of the court's explanation concerning this case is as stated in the reasoning of the judgment of the court of first instance, except for adding the following Paragraph (2) at the end of Paragraph (b) of Article 2 of the reasoning of the judgment of the court of first instance, and thus, it is citing it as it is in accordance with the main sentence of Article 4

Further, the following circumstances are acknowledged by comprehensively taking account of the entire purport of pleadings in each of the statements Nos. 5 through 8 (including a branch number) as follows. ① The part of the road was used as a road leading to a 149.9mm2 as well as a 149m2 in the copy of the cadastral map attached to the judgment of the court of first instance from the time before the Plaintiff acquired the ownership of the land before the subdivision of the case. The Plaintiff also knowingly purchased the part of the road of this case including the part of the road of this case, and continuously used the part of the road of this case as the road of this case, under the premise that the Plaintiff deducts the part of the road of this case into the use of the road of this case. ② After dividing the land of this case into the factory of this case and the road of this case (the change of land category was made on March 3, 199), the land of this case was sold to the Defendant as the site of this case without compensation between the Plaintiff and the Defendant.
