A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
"2018 Highest 592"
1. On February 4, 2018, around 19:25, the Defendant: (a) went to the “Et” of the victim’s D Operation, Seo-gu, Daegu-gu, Daegu-gu, in mind that the victim’s surveillance was neglected; (b) intrudes the victim’s office and the store used for the storage of goods; and (c) 100,000 won in cash owned by the victim in the front line; (d) 10,000 won in cash owned by the victim in the front line; (e) 1, lot cards; (e) 1, 1, 1, 1, 1, and 1, one car driver’s license.
Accordingly, the defendant invaded another person's structure at night and stolen another's property.
2. On February 4, 2018, the Defendant: (a) purchased food equivalent to KRW 8,400 from E Et, around February 19:25, 2018; (b) presented to the victim D a new card that was stolen as described in the foregoing paragraph; and (c) attempted to acquire pecuniary profits equivalent to the above amount by settling the account as if he/she used his/her credit card; (d) however, the Defendant failed to perform such intent with the wind for which the approval of the credit card was refused, and failed to commit such act.
3. On February 4, 2018, the Defendant violated the Act on Financial Business Specializing in Fraud and Credit Business: (a) around 20:02, the Defendant presented a new card that was stolen, as described in the foregoing paragraph, to the said victim as if he were using his credit card; and (b) paid a sum of KRW 86,000,000, total market price of five times, as indicated in the list of offenses, by using the said credit card.
Accordingly, the defendant, by deceiving victims, exempted them from paying a total of 86,00 won from victims, acquired economic benefits equivalent to the same amount and used the stolen credit card of another person.
