A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

On June 25, 2015, the defendant was indicted for larceny and is currently pending in the appellate trial.

"2016 Highest 4246"

1. Larceny;

A. On May 22, 2015, the Defendant: (a) at the Gyeongbuk-dong, Daegu North Korea University located in Ulsan-gu, Daegu-dong; (b) took parallel and accessed the victim C as if they were in the building; and (c) around May 23, 2015, at the “Esing” located in Daegu-dong-gu, Daegu-gu, Seoul-gu, one copy of the modern card (credit number: F) in the name of the victim who was in the victim’s home in the toilet; and (d) one copy of the Samsung card (credit number: G) in the name of the victim who was in the victim’s home.

In other words, they stolen them.

B. On May 23, 2015, the Defendant entered a guest room located in Daegu-gu, Daegu-gu, Daegu-gu, in which the said victim was accommodated, and taken custody of his arms and shoulder, and deducted a half of the market price of the victim’s fingers, which is equivalent to KRW 400,000,00 from the market price of the victim’s fingers.

In addition, they stolen them.

2. Violation of Acts in financial business specializing in fraud and credit;

A. On May 23, 2015, at around 04:56, the Defendant presented the victim’s modern card, which was stolen as stated in the above paragraph 1(a), to the victim, as if he/she uses his/her credit card, 4.20,00 won in the drinking value, etc., and 3.20,000 won in the said credit card and signed the sales slips, and then delivered it to the said victim.

B. On May 23, 2015, at around 05:29, the Defendant presented the said C’s modern card, which was stolen as indicated in paragraph (1) of the same Article, as if he/she used his/her credit card, paid KRW 4.60,00 won in the drinking price, etc., and continuously presented the said C’s Samsung Card, 4.60,000 won, including KRW 460,000 and KRW 3.20,00,000,000, in the said credit card, and signed on the sales slip, and then delivered it to the said victim.
