A Imprisonment of one year, Defendant B and C shall be punished by a fine of 2,00,000,000 won, Defendant D and E shall be punished by a fine of 4,00,000 won.
Reasons
Punishment of the crime
1. From November 201, the Defendant: (a) collected industrial wastes from an enterprise in the name of “K” in the Sung-si J from Masung-si, and sold them to, or transported them to, a recycling business entity.
A. On November 30, 2012, the Defendant entered into a contract with N to transport 11 kinds of defective CIS (CMOS Imm Sensor) B from the above M to N who is a waste disposal company, which was entrusted by the victim Samsung Electronic (State) in a waste warehouse located in Ansan-si, Ansan-si, 2012, and embezzled it by taking the Defendant’s custody of 1 ton truck to the above K warehouse for the purpose of having the victim, while keeping it in custody.
B. On November 29, 2013, the Defendant entered into a contract with P to transport 8 kinds of defective CISD 977km from the above M to P, a waste disposal company, which was entrusted by the said M in the foregoing M waste warehouse, for the purpose of having the victim, and embezzled by bringing them to the above K warehouse for the purpose of having the victim while being kept on the truck by the Defendant.

On May 15, 2014, the Defendant entered into a contract with P to transport 13 kinds of defective CISD 4,655kg from the said M to P, who is a waste disposal company, which was entrusted by the said M in a warehouse for waste management on commission of the said M, and embezzled it by bringing it to the said K warehouse for the purpose of having the Defendant, while being kept in custody for the victim on the truck of the Defendant.
2. Defendant B is a person who is engaged in the business of trading electronic parts, etc. with the trade name of Pyeongtaek-si and the trade name of the non-commercial name in Pyeongtaek-si.
On May 1, 2013, the Defendant purchased 11 kinds of defective CISD 780km and 4 million won, which are the stolen goods embezzled and kept by A as described in the above 1.A. at the above K warehouse.
