Punishment of the crime

The Defendant is a person who sells even a corner of clothes, etc. through online open markets, such as online shopping mall (D) and Gmarket, in the name of Gangseo-gu Seoul Metropolitan Government B 102.

No person shall use a trademark identical with another person's registered trademark for goods similar to the designated goods or use a trademark similar to another person's registered trademark on goods identical with or similar to the designated goods, and no person shall possess any trademark identical with or similar to another person's registered trademark or any other trademark for the purpose of transferring or delivering goods identical with or similar to the designated goods.

LTD. 의 BAPE 상표( 등록번호 제 858223호) 와 유사한 상표가 부착된 상의 1개를 판매한 것을 비롯하여 그때부터 2018. 1. 23. 경까지 같은 방법으로 별지 범죄 일람표Ⅰ( 판매 내역) 기 재와 같이 짝 퉁 의류, 신발 등 합계 3,080개를 판매하여 이를 양도하고, ⅱ) 2018. 1. 23. 경 위 사무실에서, 대한민국 특허청에 등록한 상표권자 발 렝 시 아가의 BALENCIAGA 상표( 등록번호 제 0680624호) 와 유사한 상표가 부착된 상의 13개를 판매 목적으로 소지한 것을 비롯하여 별지 범죄 일람표Ⅱ( 압수물) 기 재와 같이 짝 퉁 의류, 신발 등 합계 242개를 양도하기 위하여 소 지하였다.
