A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. The Defendant in violation of the Trademark Act is a domestic distribution liability for wholesale sale in the Internet following the Internet, such as “G” (H), “I” (J), and “K,” after taking advantage of counterfeit goods forged by one-person D, E, and F and carrying them into the Republic of Korea.

No one shall deliver, sell, forge, imitate, or possess a trademark identical or similar to another person's registered trademark without due authorization for the use of such trademark for the purpose of using it on goods identical or similar to the designated goods.

On September 10, 2013, in U.S. L, a trademark right holder who operated the sales site in the name of “G”, “I”, and “K” as above, thereby infringing the trademark right holder’s trademark right by selling forged goods equivalent to 20,992 items, as shown in attached Table 1 through 24, from around that time to May 31, 2016, where a trademark right holder registered with the Korean Intellectual Property Office as “LOUS VITON” (trademark No. 59471) (trademark registration number No. 59471) is attached with a trademark identical or similar trademark to “LOUS VITON” (trademark registration number No. 59471).

B. Around June 1, 2016, at a warehouse located in Nanananan-gun, Naman-gun, the purpose of which is to sell goods bearing a forged trademark of about 8,947 points ( approximately KRW 26.395 million at the fixed price) as shown in attached Table 25 of the daily list of crimes, such as where a trademark identical or similar to “LOUSVITON” (Trademark No. 59471) registered with the Korean Intellectual Property Office, is to keep one-time cover of a cover cover of a trademark attached to the Korean Intellectual Property Office, which is identical or similar to “LOUSSS VITON” (Trademark No. 59471) registered with the Korean Intellectual Property Office.
