Punishment of the crime

[2019 Highest 1625] The Defendant is an employer who, without a specific trade name or construction business license, performs construction business by ordinarily employing four workers as an employer who has been performing construction business after being awarded a contract for a pentthy construction work, etc.

When a worker dies or retires, the employer shall pay the wages, compensations, and all other money and valuables within fourteen days after the cause for such payment occurred.

Provided, That in special circumstances, the date may be extended by mutual agreement between the parties.

Nevertheless, the Defendant did not pay the total of 35,30,000 of the wages in arrears of 13 workers who worked at the construction site, such as Sung-si and Seo-si, etc., in addition to the wages in arrears of 600,000 from August 22, 2018 to December 21, 2018, as stated in the attached Table 1, as well as the wages in arrears of 13 workers who worked at the construction site, such as Sung-si and Seo-si, etc., in addition to the wages in arrears of 14 days from the date of retirement without any agreement on the extension of the due date between the parties.
