Defendant

A shall be punished by imprisonment with prison labor for ten months, and imprisonment with prison labor for six months.

Punishment of the crime

1. Defendant A

A. The Defendant, from around 18:00 on December 30, 201 to around 21:00, found the street store operated by the victim E in front of the Dongdaemun-gu Seoul F building, Dongdaemun-gu, Seoul, for the reason that the victim’s street occupies a large place and the Defendant’s dong-B’s street store located next to the Defendant’s dong-gu store became narrow, the Defendant expressed the Defendant’s desire to “all feass, feass, feass, feass, fass, fass, fass, fass, fass, fass, and fass,” and fasssing both customers, and interfere with the Defendant’s operation by force by force.

나. 피해자 G에 대한 범행 1) 폭행 가) 피고인은 2013. 9.월 중순 일자불상 17:00경 위 F건물 앞 피해자 G(여, 50세)이 운영하는 오뎅 노점상에 찾아가 전날 피해자와 피고인의 동생 B이 다퉜다는 이유로 피해자에게 “네가 내 동생한테 그러면 쓰냐”라며 주먹으로 피해자의 등을 수 회 때려 피해자를 폭행하였다.

나) 피고인은 2014. 2. 16. 15:00경 위 F건물 앞 피해자 G이 운영하는 오뎅 노점상에 찾아가 피해자에게 “야, 너네 장사 하지마, 너네 들어가, 내일부터 나오지마, 싸구려 오뎅을 가져다가 800원씩 받는 도둑년아”라는 등의 욕을 하며 주먹으로 피해자의 등을 수 회 때려 피해자를 폭행하였다. 2) 업무방해 피고인은 2014. 2. 16. 19:30경 위 F건물 앞 피해자 G이 운영하는 오뎅 노점에 찾아가 떡볶이 판에 침을 뱉고 손님들 앞에서 “에이 도둑년아 싸구려 오뎅을 800원에 파는 도둑년아”,"다이나마이트를 터뜨려버려, 이 개같은 년아, 보지에 붕알을 씹어 먹어도...
