A defendant shall be punished by imprisonment for a term of one year and two months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. 폭력행위등처벌에관한법률위반(집단ㆍ흉기등협박) 피고인은 2013. 3. 7. 23:30경 포항시 북구 B 소재 피해자 C(여, 48세) 운영의 ‘D’ 식당에서 피해자가 술을 주지 않는다는 이유로 화가 나 피해자에게 “십할년 니도 내보고 무시하나”라는 등의 욕설을 하며 주방 안쪽에 들어가 칼을 찾는 시늉을 하며 겁을 주고, 이에 피해자가 경찰에 신고를 하였다는 이유로 그 곳에 있던 위험한 물건인 철제 쇠스랑(길이 120cm)을 들고 위 식당 안으로 들어가 피해자에게 “십할년 죽여 버린다”라는 등의 욕설을 하며 때릴 듯이 휘둘러 협박하였다.

2.
