A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On September 15, 2019, the Defendant violated the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (Indecent Acts at Open Place) was seated by the victim C (at the age of 20) who was seated and locked in the front train in the subway 4 line area and the Han River Station operating between the 0:30 to 00:40 on September 15, 2019.

Accordingly, the defendant committed indecent acts against the victim in means of public transportation.

2. The Defendant, at the time and place specified in paragraph (1), taken photographs of the victim’s chest part of paragraph (1) using the gallon function of Samsung 7 Smartphones owned by the Defendant against his will during the period from June 2, 2018 to September 15, 2019, as described in the list of crimes in the separate sheet of crimes (i.e., the victim’s body 17 victims, who may cause sexual humiliation or sense of shame on 16 occasions, such as the list of crimes in the separate sheet of crimes).

Summary of Evidence

1. Application of the following Acts and subordinate statutes to each of the records of seizure, the list of seizure, the representative of each list of crimes, and the closure photographs of the defendant;

Article 11 of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes (amended by Act No. 17264 of May 19, 2020) on the Punishment, etc. of Sexual Crimes (amended by Act No. 17264 of May 19, 202), Article 14(1) of the former Act on Special Cases concerning the Punishment, etc. of Sexual Crimes (amended by Act No. 17264 of May 19, 2020)

1. Articles 40 and 50 of the Criminal Act of the Commercial Concurrent Crimes;

1. Selection of each sentence of imprisonment;

1. Of concurrent crimes, the former part of Article 37, Articles 38 (1) 2 and 50 of the Criminal Act;

1. Article 62 (1) of the Criminal Act;

1. Article 16 (2) and (4) of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes against Order to attend lectures or Order to provide community service;

1. Where a conviction becomes final and conclusive on the facts constituting a sex offense subject to the registration and submission of personal information under Article 48(1)1 of the Criminal Act, the accused shall obtain personal information under Article 42(1) of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes.
