All appeals by the Defendants are dismissed.

Reasons

1. Summary of grounds for appeal;

A. It is true that the victims of misunderstanding of facts and misunderstanding of legal principles made Defendant A improper dismissal and pressure the labor union of G Co., Ltd. was true.

Even if the victims were not unfair dismissal and labor union pressure, there was a considerable reason to believe that the Defendants were true facts, and the Defendants’ expression as stated in the facts of the crime in the judgment below is related to public interest, and therefore, it constitutes grounds for excluding illegality under Article 310 of the Criminal Act.

Nevertheless, the court below found Defendant guilty of the facts charged of this case. The court below erred by misunderstanding facts or by misapprehending legal principles, which affected the conclusion of the judgment.

B. The lower court’s punishment on the Defendants of unreasonable sentencing (a fine of two million won) is too unreasonable.

2. Determination

A. In full view of the following facts and circumstances acknowledged by the lower court and the evidence duly admitted and investigated by the lower court that did not have any false facts as to the assertion of mistake of facts and misapprehension of legal principles, the victims shall be deemed to have been unfairly dismissed, or the labor union of G Co., Ltd., was not abused, and thus, the facts alleged by the Defendants are deemed to be false.

Therefore, this part of the Defendants’ assertion is without merit.

㈎ 피고인 A은 2009. 9. 1. 주식회사 G에서 운전원으로 근무하다가 위 회사가 주식회사 D과 주식회사 G로 분할되자 주식회사 D으로 근로계약이 승계되어 주식회사 D에서 동일한 운전원으로 근무하였다.
