The defendant's appeal is dismissed.

1. Summary of the facts charged in this case and the judgment of the court below

A. On October 10, 2013, the summary of the facts charged in the instant case is that the victim E acquired and operated the ownership by winning a factory located in the Chungcheongbuk-gun (hereinafter “instant factory”).

The Defendant is the owner of the above C’s land adjacent to the south of the above factory site (hereinafter referred to as the “instant warehouse”) and the above ground warehouse (hereinafter referred to as the “instant warehouse”). The Defendant leased and operated the instant factory before the Defendant was awarded a successful bid.

On the other hand, the right side of the factory and warehouse of this case passes across the west side (the upper red ship is the victim's factory and the lower side is the defendant's warehouse). There is an access road (the yellow part of the front side photograph) between the factory and warehouse site and the road.

The access road is a concrete package, and it has been installed over three parcels, such as F (road site, State-owned land), G (national ditch, State-owned land), H (dry field, L).

The following is the road access right of this case:

Under such circumstances, the Defendant interfered with the victim’s factory operation by force by blocking the flow of vehicle traffic through a X (see the following photographs) by putting a shot-type tension (hereinafter referred to as “each pipe of this case”) on the above-mentioned road to prevent the victim from using the said road when entering the factory of this case on March 9, 2014.

B. As to the above facts charged by the court below, the court below stated in the court below and the police investigation that recognized the establishment of each officer as above.
