The appeal is dismissed.
The costs of appeal are assessed against the Defendant (Counterclaim Plaintiff).
Reasons
The court of final appeal may investigate and determine only to the extent of filing an appeal based on the grounds of final appeal. As such, the grounds of final appeal should specify the grounds of final appeal and explain specific and explicit reasons as to how the lower court violated the statutes.
(see, e.g., Supreme Court Decision 2010Da24435, Sept. 9, 2010). According to the records, the instant ground of appeal submitted by the Defendant (Counterclaim Plaintiff) is merely stated in the purport that the lower judgment is unreasonable, and it does not state specific and explicit grounds as to what portion of the lower judgment violated laws and regulations. Thus, the legitimate ground of appeal cannot be indicated.
Therefore, the appeal is dismissed, and the costs of appeal are assessed against the losing party. It is so decided as per Disposition by the assent of all participating Justices on the bench.
