1. The Plaintiff:

1. Facts of recognition;

A. The Plaintiff operates an individual broadcasting station called “E (F)” from the Internet TV operated by African TV Co., Ltd. to the clinic called “D” from 2007 to the clinic.

나. 2013. 7. 4. 원고가 방송하는 위 ‘E’ 채팅창에 “이 사람은 빨갱입니다 대한민국은 휴전중이지 전쟁이 끝난게 아닙니다 그런데도 불구하고 우리에 주적인 빨갱이들을 옹호한다는 것은 국가보안법 위반이다 빨갱♡아”라는 글이 게시되었는데 위 글 작성자가 사용한 아이디는 피고 B의 ‘G'이였다.

[Reasons for Recognition] In light of the fact-finding without dispute, Gap evidence Nos. 1, 3-1, 2, and 4-1, Africa's fact-finding results, the overall purport of the pleadings (the defendant Eul asserted that the materials submitted by the plaintiff can be fabricated, so it is not admissible as it is possible to manipulate the materials submitted by the plaintiff, but it is reported immediately after the holding of the case, and the defendant Eul also recognized that the above materials were written by himself in the preparatory documents dated March 13, 2017, the above evidence is admissible as evidence according to the whole purport of the pleading, and there is no evidence that it is sufficiently recognized and fabricated as evidence, and thus, the defendant Eul's assertion is not acceptable).

2. Determination

A. According to the above facts of recognition, the Defendants insulting the Plaintiff by using a language lower than the open hosting window of Internet personal broadcasting, in which many and unspecified persons can confirm the contents of writing, and it is obvious in light of the empirical rule that the Plaintiff was suffering from mental pain. Therefore, the Defendants are obliged to act in monetaryly against the Plaintiff.
