Punishment of the crime

1. Where an occupant enterprise that owns an industrial site or a factory, etc. of a defendant A, etc. intends to dispose of such factory, etc., it shall transfer such factory, etc. to a management agency, and if the management agency is unable to purchase the factory, etc., it shall transfer such factory to another enterprise, etc.

On March 9, 2016, the Defendant entered into a contract for occupancy of C factory buildings owned by the Korea Industrial Complex Corporation (TGP) and a company in an industrial facilities zone B, which is a management agency, and completed the report on the completion of the establishment, etc. of a factory on March 15, 2016.

On November 17, 2017, the Defendant applied for the disposal of the above factory building on the ground of business deterioration to the above management agency, but the management agency could not purchase the factory building.

The Defendant entered into a sales contract with F Co., Ltd. and completed the registration of ownership transfer of factory buildings on January 31, 2018 to F Co., Ltd. around January 31, 2018, at the E Licensed Real Estate Agent Office located in the Gu, Si, Si and Do (D) around January 18, 2018, when the procedure for selecting a transferee of a management agency was not completed.

2. Defendant B, a representative director, committed such a violation as above with respect to the Defendant’s business at the above date and place.
