Punishment of the crime
[criminal power] On December 15, 2010, the Defendant was sentenced to two years of suspension of the execution of imprisonment with prison labor for five months for fraud, etc. in the Suwon District Court Ansan branch on December 15, 2010, and the judgment became final and conclusive on December 23, 2010.
【Criminal Facts】
1. On November 10, 2008, the Defendant forged private documents, without B’s consent, entered the name “B”, “B”, “C”, “27,312,000 won”, “465,306 won”, and “B” in the applicant column, and affix B seal.
Accordingly, for the purpose of uttering, the Defendant forged a letter of installment financing and loan agreement in the name of B, a private document on rights and obligations.
2. At the time and place specified in paragraph (1), the Defendant: (a) delivered forged installment financing and loan agreements as if they were genuinely formed to a non-employee of the social group Samsung F&M, who was aware of the forgery; and (b) exercised them.
3. Around November 10, 2008, the fraud Defendant: (a) purchased a vehicle from a dormitory within the DD Hospital in Ansan-si to the victim B by a string of the next week on the wind that the delivery vehicle, among consignment, was scrapped due to an accident, will receive compensation from the mother; and (b) would then purchase SM5 vehicle by a string of the next week on the string. However, if the mother purchases a vehicle under his/her name, the mother would lend the name of the vehicle to the head of the Viewing transportation division and transfer it to the latter after the lapse of 1-2 months.
However, the defendant did not have the intention or ability to purchase the vehicle in cash and did not have the intention or ability to pay the installment of the vehicle.
As such, the Defendant, by deceiving the victim B, shall obtain from the victim the certificate of seal impression, resident registration, identification card, copy of the new bank account, family relation certificate, and withholding receipt in the name of the victim, and shall be 28,462,00 won at the time and place specified in paragraph (1).
