1. The defendant Republic of Korea shall, on December 16, 1968, file with the plaintiff the Suwon District Court concerning the land size B B 2,516 square meters.
Reasons
1. Facts of recognition;
A. According to the old copy of the register on the land before the division of Gyeonggiwon-gun C 6,621 (hereinafter “the land before the division of this case”), it is stated that the F [F, Chang Chang-si name G] having the address in Gyeonggi Suwon-gun D (Revised administrative district name: Suwon-si, Suwon-si) was completed the registration of transfer on April 9, 1940 on the land before the division of this case on the ground of sale as of March 20, 1940.
B. The Defendant Republic of Korea purchased the land before the instant subdivision pursuant to the former Farmland Reform Act (amended by Act No. 31 of Jun. 21, 1949, repealed by Act No. 4817 of Dec. 22, 1994). After the instant subdivision, the land before the instant subdivision was divided into the land H return I or J on December 30, 1958.
C. From among the divided lands as above, the remaining land except for the Gyeonggi-gun K 761 square meters (2516 square meters in Gyeonggi-si, according to the change of the name of the administrative district, and the conversion of the area into the unit; hereinafter “instant land”) was completed and the ownership transfer registration was completed in the name of several distributors.
However, although the instant land was distributed to L, it is stated to the effect that the instant land was distributed to L, but there was no indication that the payment of farmland has been completed in the repayment ledger, and there was no indication that “M was disposed of as of April 7, 1964,” and that the instant land was deleted from the repayment ledger as one of the parts in which the instant land was entered.
Since then, the defendant Republic of Korea completed the registration of ownership transfer of the land of this case by the Suwon District Court of Suwon District Court No. 23717, Dec. 16, 1968, which was received on December 16, 1968.
Defendant Gyeonggi-do entered into an exchange contract with Defendant Republic of Korea on December 31, 1993, and completed the registration of ownership transfer with the Sungwon District Court Law No. 39745 on August 23, 1994, and occupied and managed it.
