Punishment of the crime

No passenger on board shall engage in any disturbing conduct, such as verbal abuse, loud singing, etc., to ensure the safe flight and travel of aircraft and passengers.

그럼에도 불구하고, 피고인은 2015. 11. 21. 09:45 분 중국 북 경에서 출발하는 B 소속 C 편에 탑승하여 기내 전파 방해 전자제품 사용금지, 좌석 안전벨트 착용, 항공기 이 ㆍ 착륙시 이동금지 등 주의사항에 대한 사전 경고방송이 있었음에도 불구하고, 이륙 후 김 포 공항까지 비행 도중 55분이 경과한 10:40 경 핸드폰을 켠 상태로 손에 들고 이어폰을 귀에 꽂고 음악을 듣고, 착륙 시점에 좌석에서 이탈하여 항공기 내 화장실로 이동하는 것을 보고 승무원들이 수차례 제지하자, 승무원들에게 “ 자신은 암환자 다”, “ 핸드폰을 끌 테니 명령 투로 말하지 마라 ”며 항의하고, 계속해서 “what the fuck” 라며 폭언과 함께 좌석 위에 설치되어 있는 수화물 덮개를 주먹으로 1회 가격하는 등 운항 중인 항공기 내에서 폭언을 하고 고성을 지르는 등 소란행위를 한 것이다.
