피고인은 2016. 2. 14. 20:10경 경남 합천군 C에 있는 D 마을회관 안에서 농협중앙회로부터 지급받은 주말영농주택사업 관련 지원금을 영농조합법인을 위해 사용하지 아니하고 피고인 개인의 채무변제 등 명목으로 사용한 것과 관련하여 피해자 E(51세)과 사이에 서로 말다툼을 하던 중 격분하여 위험한 물건인 소주병을 집어 들고 피해자에게 “대가리를 쌔리 찔러뿔라. 씨발놈 개새끼. 내가 니 죽일끼다. 칼로 목을 딴다.”라고 말하는 등 피해자를 협박하였다.
