A defendant shall be punished by imprisonment for not more than ten months.
Reasons
Punishment of the crime
1. Fraud;
A. Around October 2013, the Defendant against the victim C told the victim C to the effect that “if the costs are paid, the Defendant was issued with an employment visa who can stay in Japan, and would return the cost if the employment visa is not paid,” at the E Tourhouse located in Yeongdeungpo-gu Seoul Metropolitan Government 601.
However, the defendant did not have the intention or ability to return the cost to the victim even if he did not leave the job.
Nevertheless, on November 15 of the same year, the Defendant, by deceiving the victim as above, received 6.6 million won from the victim to the agricultural bank account in the name of the Defendant, as the cost of issuing employment visa from the victim, and acquired it by fraud.
B. Around November 2013, the Defendant against the victim F told the victim F at the H office located in Dongjak-gu Seoul Metropolitan Government G H office to the effect that “When paying the cost, the Defendant would be issued with employment visa who can continue to reside in Korea.”
However, the defendant did not have the intention or ability to obtain a Korean employee visa from the victim.
Nevertheless, the Defendant, by deceiving the victim as above, received KRW 700,000 from the victim at the end of November of the same year, in cash, and received KRW 2 million on December 18 of the same year, KRW 2 million on January 23, 2014, and KRW 2 million on January 23, 2014; and
2.3.1 million won was remitted to the Agricultural Cooperatives Deposit Account in the name of the Defendant and acquired it by fraud.
2. The Defendant, along with I, conspiredd to forge the marriage relation certificate, basic certificate, and family relation certificate against C for the purpose of using it for the Japanese employment visa visa against C as described in the above paragraph 1(a).
I is the addition of C (date of birthJ, resident registration number K, gender leisure, L) under the name of the head of Jongno-gu Seoul Metropolitan Government on November 20, 2013, and C without authority, for the purpose of exercising it in an unsound place on November 20, 2013 according to the above public offering, and is married by C.
