A defendant shall be punished by imprisonment for one year.

Punishment of the crime

1. No person who fails to register a driving school shall display or advertise its trade name using a name similar to that of a driving school, etc.;

Nevertheless, without registering the above driving school, from January 2018 to October 2019, the Defendant advertised the first-class dancing education for the first-class drivers using the name similar to the driving school by publicizing the first-class dancing education from the first-class drivers as if they conduct legitimate road training, such as driving training in front-round daily newspapers in the area of North Korea and Internet B, etc. as “C”. “All kinds of driver training in front-round,” “the driver’s license for the second-class driving training”, and “the driver’s license for the second-class, the second-class driver’s license for the first-class driving training, and the first-class dancing education for the first-class drivers, such as inserting the first-class driver’s license for the first-class driving training service, and the second-class driver’s license for the second-class driving training.”

2. Anyone who fails to register a driving school with the Commissioner of a Local Police Agency shall not conduct driving education for motor vehicles outside the driving school in return for payment;

Nevertheless, on December 9, 2018, the Defendant: (a) received a total of KRW 530,000, including KRW 380,000 on December 9, 2018 and KRW 530,000 on December 15, 2018 from D, which was found in order to receive driving education, without registering the said driving school; and (b) provided driving education among the students from November 3, 2018 to September 28, 2019, after receiving total of KRW 28,536,00 as indicated in the attached Table of Crimes.
